Emulators are legal. Downloading ROMs you do not own is illegal.

Indeed, emulators are fine. If you want to stay legal you can only download ROMs/ISOs of games you actually own, and BIOS/OS images of consoles/computers you actually own.

It really irks me that they charge for the NES emulator now. And that its 6 bucks.

Yep, it's illegal to download roms whether you own the game or not. It's legal to use a backup device to rip the rom from a game cartridge you own and only use it for yourself, though.

You are both sort of right but neither of you are specific enough. Mindfield is a fellow Canadian and, for us, he is correct. Our Copyright Act specifically makes exception for backups and "format shifting" if it is only for personal use. Countries such as Australia and New Zealand specifically forbid copying for personal use except in the case of software (you are allowed a single backup copy.) The US laws are (perhaps intentionally) vague by comparison. I would be afraid to put it to the test there.

In any case, TA should not be the source of your legal advice. Consult a lawyer or study the laws yourself.

I don't think copying the ROM once for personal use is not illegal, because you're not going to make any money out of it by selling it right.
