it is not yet illegal, later this year conrgress will open up those laws and make revisions. apple sent in the recommendation for making jailbreaking illegal awhile back, congress or whatever comittee is deciding wether to accept or deny that request we wont know until around July the decision. at this time jailbreaking is not illegal, apple can reuse you service for doing so, but there is no legal rammifactions that apple can take upon you.
even apple does not call it illegal, they can't until it's passed as a law.

It doesn't really seem illegal. If you're thinking of jailbreaking, you should. It's actually pretty cool especially Winterboard which gives you themes to your homescreen and everything and also Cycorder which gives you video recording :D always need that on a phone.

Apple sees it as illegal because people have the opportunity to use cracked apps. It's like with other devices. For the DS and PSP, you can play great homebrew games, but the ability to download ISO's are what scares Sony and Nintendo so they make certain hacks and devices (R4) illegal.
I think that they (Apple) will end up having the power to make it illegal, much like the R4 got banned in Japan and it manufacturing was stopped. As of right now, Apple cannot take any legal actions to anyone who is jailbroken, but if you take it into the store and they know it has been jailbroken they have the option to not help you or service your iPod.

I could see iTunes detecting the device being JB and charging a fee to your account, but even that'd be extreme.

They could not charge you without any agreement of a judge or you could charge apple....

i think jailbreaking is awsome. You get to completely pimp out your idevice which is IMPOSSIBLE for an ordinary idevice. This makes people extremely interested in their product. Dont you think if they wanted to make it illegal it would have been done already? Think about it for a second. They could erase anything they want to and literally go on strike completely demolishing the idea of jailbreaking. Plus, if they did make it totally illegal and banned, they would lose most of their customers :)
