It just struck me that atari have trademarked Touch. So how does that work? Does that mean if someone wants to use the word Touch they have to ask permission of atari to use the word Touch. If someone wants to use Touch in a title of a game they cant unless atari give them permission? This reminds of when King tried to trade mark candy wasn't it?
I haven't read their particular application, but in cases like this they do need to provide context - they cannot literally trademark the word "touch" in any and all uses. Based on no real information - chances are, they trademarked it for use at the ends of titles. E.g. Pocket Game Touch might be infringing, but Touch My Pocket wouldn't be. It would make sense if they wanted to release mobile versions of all their games and keep them all similarly named. Asteroids Touch (tm) Centipede Touch (tm) Breakout Touch (tm)
