I'm not aware of any clause like that in the terms. Lots of apps employ this type of system. Eliminate for example runs a banner at the bottom that displays the current promotion. You aren't allowed to download and run executable code, but text and images certainly don't fall into that category.
Flickitty has a banner system that was intended to send urgent news if necessary (serious bugs or flaws). It has gone unused, so we used it to push another unrelated developers game- Charmed. No, it isn't against Apples rules and we don't download any runnable code. In the future, it will be used to inform people about the built-in map editor, and point to a user guide.
