You know when he says "that website", that in English is often derogatory meaning a competitor's website such as IGN, 148apps, pocketgamer, etc. If it said this website, it would be different for a comment like yours.
Technically it's not legal. If you're the type of person who has no illegal mp3s, doesn't download tv shows and doesn't drive 1 Km over the speed limit then stay away from Roms! It's a big gray area. Many games are 20-30 years old and the only way to play them is via emulators. Still doesn't make it technically legal but people 'take the risk'
I don't think its derogatory. I think he means a certain website for non jail broken phones (sure we know what one it is)

Of course it is but like I say it's a huge gray area. Do I feel guilty playing 25 year old roms? Nope. It's still wrong but personally I don't think it as bad as cracking apps, downloading music or speeding in a car etc. if the original poster is worried then just don't bother using emulators
I don't feel anything wrong with emulating something when I have no way to support the people who developed the game
