It is from a different developer/publisher, but has been on the AppStore for half a year. So it's weird that they didn't remove it yet if it was some huge scam. I guess the othe issue is the specific meaning of "scam" when describing an app. I usually think of a scam app as one where the screenshots are not from the game, and actual gameplay is either nonexistent or terribly poor. Source code does not mean: graphic assets, music, icons, and all other artistic stuff. Code is a just a code. Like Doom source code is free and quake and other games. But you can't use even one texture from the original if you try to use a source code.
