From the level design, this looks to be a 2.5D game, which isn't a bad thing IMHO.

no it doesn't... the ball always seems to stay at the center of the camera and in more than one screen its moving in a circle so how can that be 2.5D not to mention that all the object are clearly 3D

From the Wikipedia article 2.5D:

"2.5 platformers are sidescrolling platforming games that use polygons to render the world and characters (3D graphics) but the gameplay is restricted to a 2D plane."

i know what 2.5D is and if there is a circle on the screen, and the ball stays centerd on the camera how do you think it could move around that circle in a 2D plane?

edit: i just checked the description on the app store and it says "fluid" 3D graphics

Easy. The ball "stays put" and the level rotates. Lots of older games have done that.

In other words, you can move left/right/up/down, but not in/out (else you'd probably fall off the track very easily!
