It doesn't necessarily have to look similar to be sued. In fact, most of these type of lawsuits are based on licensing terms and technology use meaning the stuff behind the scenes. Believe me, if lawsuits were based on things that looked similar, about 90% of the apps in the iTunes store (and 100% of your TV shows) would be facing lawsuits.
